In
cases where a Canadian company or individual has invested substantial
capital in a U.S. enterprise a work authorization may be available
as an investor or a manager. Essential employees may also qualify.
The regulations require the U.S. company to be owned at least
50% by Canadian nationals.
Our
office has used this category in connection with hockey teams
controlled by Canadian investors. If the team has Canadian ownership
it can then sponsor other Canadians to fill key roles in the business
(i.e., general manager, coach, etc.).
Work
authorizations are granted by the U.S. Consulates in Vancouver, Calgary, and Toronto;
are typically valid for five years; and, are renewable.
